Anastasia La Fey uses the stable, secure online payment processing platform, Stripe to process payment through the online Stockroom cart. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1 - the most stringent level of certification available in the payments industry.

While expert care is taken when packing prints, occasional damage may occur due to improper handling in transit. In the unlikely event that your parcel goes missing or your print doesn’t arrive in pristine condition, Anastasia La Fey will have the artwork reprinted and resent to you, free of charge. (subject to damaged prints being returned to the artist in order to protect edition authenticity and associated guarantees).

Should your print arrive damaged you are responsible for contacting Anastasia La Fey within 7 days of delivery via anastasialafey@anastasialafey.com and return ship the artwork by a trackable service within 21 days. You are responsible for return shipping costs which will be credited back to your account upon receipt of the returned products (subject to the artwork being assessed as legitimately damaged).

If you are sent the incorrect artwork(s), Anastasia La Fey will gladly accept returns. Please contact the artist via anastasialafey@anastasialafey.com within 7 days of delivery and return ship the artwork by a trackable service within 21 days. A full replacement or refund will apply including any shipping costs. You are responsible for return shipping costs which will be credited back to your account upon receipt of the returned products. If the item is not returned in its original condition as received by you, then the refund commitment is void.

All other refunds are handled on a case-by-case basis. Working with specialist printers, Anastasia La Fey endeavours to make all her prints to the highest possible standard and will work with you to resolve any problems, should they arise.

In using the Purchase Services to purchase the Product through the Website, you will agree to the payment of the purchase price listed on the Website for the Product (the 'Purchase Price').

Payment of the Purchase Price may be made through Stripe Inc (the 'Payment Gateway Provider'). In using the Purchase Services, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Payment Gateway Provider.

Following payment of the Purchase Price being confirmed by Anastasia La Fey, you will be issued with a receipt to confirm that the payment has been received and she may record your purchase details for future use.

The artist may, at her sole discretion, provide a refund on the return of the Products within 21 days days where the Product packaging is unopened and remains in a saleable condition. You acknowledge and agree that you are liable for any postage and shipping costs associated with any refund pursuant to this clause.

Anastasia La Fey fine art photographic prints come with a 50-year replacement guarantee if the recommended care instructions - https://www.anastasialafey.com/print-care-instructions - are followed and the print is mounted archivally and framed with UV glass or perspex. The quality of materials used and experience of Hound and Bone studio produce fine art prints of exceptional quality and longevity.

Anastasia La Fey's Fine Art Photographic Prints come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of the Product and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the print replaced if it fails to be of acceptable quality and the failure does not amount to a major failure (the 'Warranty').

You may make a claim under this clause (the 'Warranty Claim') for material defects and workmanship in any Fine Art Print within 50 years from the date of purchase (the 'Warranty Period') subject to the return of the print and adherance to the warranty conditions laid out below.

In order to make a Warranty Claim during the Warranty Period, you must provide proof of purchase to Anastasia La Fey showing the date of purchase of the Products, provide a description of the Products and the price paid for the Products by email at anastasialafey@anastasialafey.com.

Where the Warranty Claim is accepted then the artist will replace any defective Fine Art Print during the Warranty Period at no charge to you. You acknowledge and agree that you will be solely liable for any postage or shipping costs incurred in facilitating the Warranty Claim.

The Warranty shall be the sole and exclusive warranty granted by Anastasia La Fey and shall be the sole and exclusive remedy available to you in addition to other rights and under a law in relation to the Products to which this warranty relates.

All implied warranties including the warranties of merchantability and fitness for use are limited to the Warranty Period.

The Warranty does not apply to any appearance of the supplied print nor to the additional excluded items set forth below nor to any supplied print where the exterior of which has been damaged or defaced, which has been subjected to misuse, abnormal service or handling, which has been altered or modified or to fine art prints which have not been mounted archivally and framed with UV glass or perspex.

Limited edition refers to the number of prints that are available for that particular artwork. The number of prints in an edition is determined by the artist.

In a limited edition print you will get the following: numbered prints (1/25 to 25/25 for e.g) and artists proofs (A.P 1/3 for example, where the 3 indicates the number of artist's proofs). There may also be workshop proofs (W.P) and printers proofs (P.P) and a Bon a tirer print, which is the approval to print. The tradition of limited edition prints is to have the numbered prints and then the various proofs editioned in addition to the numbered ones. This means that the artist will have a copy or copies of the print and that the workshop and printer may also have a collection of the limited edition work that they have done.

Every fine art photographic print produced by Anastasia La Fey is accompanied by a COA (Certificate of Authority) which records the details of the edition. This is your guarantee that the edition is limited and will not be re-printed.

Every limited edition print purchased is accompanied by a Certificate of Authenticity (COA), certifying it’s origin and authenticity and the purchasers guarantee that the edition is limited and will not be re-printed. It also protects the artists' rights.

Each print is also associated with a unique number which is recorded by the artist in a central database for provenance. Upon receipt of payment you will be sent (via email) a digital card with a record of the purchased work's unique number and a confirmation that you are now registered as the legitimate owner of the artwork. Should you lose or damage your COA, this unique number is your proof of artwork ownership and can be used to request a replacement COA. Any replacement COA is produced and supplied at full cost to you.

Limited editions are printed to order and may take up to 21 days before posting, should you require an urgent turn-around on your order please contact Anastasia La Fey directly and she will do her best to accommodate your request.

These are indicative turn around times, and are to be used as a rough guide. The artists' workload changes from time to time, and turn arounds will also change accordingly.

Anastasia La Fey works with Hound and Bone to have your artwork shipped directly to you from their print studio and can send prints almost anywhere in the world.

Prints smaller than A2 are sleeved in archival polypropylene sleeves and mailed inside a custom-sized mailer box. Larger prints are rolled carefully in an archival poly film and shipped in strong mailing tubes.

All orders within Australia are sent with tracking via Australia Post eParcel and require a signature on delivery. All international orders, excluding UK (see below) are sent with tracking via DHL. Rates include DHL-imposed Emergency Surcharges. Due to COVID-related freight issues, surcharges fluctuate and so international postage rates are subject to change without notice. The receiver may be required to pay taxes and duty on delivery. These rates are set by the destination country. Anastasia La Fey is not liable for any unforeseen import expenses.

As of January 01, 2021 Anastasia La Fey will no longer be shipping to Great Britain. This is due to VAT related changes that would require her to register for a UK VAT number, charge VAT at the point of sale and remit to Her Majesty Revenue and Customs (HMRC)

Anastasia la Fey cannot be held liable for any delays in postage or shipping that may occur and in purchasing a print to be shipped you are agreeing to the terms and conditions set out by any third party shippers and carriers.

If you supply an incorrect address in your order and the parcel is returned, a $10.00 eParcel-issued RTS (Return To Sender) fee applies, in addition to the cost of re-delivery.

You acknowledge that the Purchase Services offered by Anastasia La Fey integrate delivery (the ' Delivery Services') through the use of third party delivery companies (the ' Delivery Service Providers').

In providing the Purchase Services, Anastasia La Fey may provide you with a variety of delivery and insurance options offered as part of the Delivery Services by the Delivery Service Providers. You acknowledge and agree that she is not the provider of these delivery and insurance options and merely facilitates your interaction with the Delivery Service Providers in respect to providing the Delivery Services.

In the event that an item is delayed, lost or damaged in the course of the Delivery Services, the artist asks that you contact her by sending an email to anastasialafey@anastasialafey.com informing her that you have either;

(a) not received your order

(b) outlining in what way the print was damaged in transit

so that she is able to act on locating a lost print or replacing a damaged print (subject to its return to the artist) and so she can determine if the Delivery Service Provider should be removed from the Purchase Services.

In accordance with Australian copyright law, a person who owns copyright of a work/artwork has the exclusive rights to produce copies of that work. The copyright owner may also allow others to make copies of their work. To legally produce copies of another person’s artwork, you must have the express permission of the creator/copyright holder.

TERMINATION OF CONTRACT

The Terms will continue to apply until terminated by either you or by Anastasia La Fey : artist I maker I designer as set out below.

If you want to terminate the Terms, you may do so by:

(i) notifying Anastasia La Fey at any time; and

(ii) closing your accounts for all of the Purchase Services which you use, where Anastasia La Fey has made this option available to you.

Your notice should be sent, in writing, to Anastasia La Fey via the 'Contact' link on her homepage.

Anastasia La Fey may at any time, terminate the Terms with you if:

(i) you have breached any provision of the Terms or intend to breach any provision;

(ii) Anastasia La Fey is required to do so by law;

the partner with whom Anastasia La Fey offered the Purchase Services to you has terminated its relationship with the artist or ceased to offer the Purchase Services to you;

Anastasia La Fey : artist is transitioning to no longer providing the Purchase Services to Users in the country in which you are resident or from which you use the service; or

the provision of the Purchase Services to you by Anastasia La Fey is, in the opinion of the artist, no longer commercially viable.

Subject to local applicable laws, Anastasia La Fey reserves the right to discontinue or cancel your membership to the Website at any time and may suspend or deny, in her sole discretion, your access to all or any portion of the Website or the Purchase Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Anastasia La Fey's name or reputation or violates the rights of those of another party.

When the Terms come to an end, all of the legal rights, obligations and liabilities that you and Anastasia La Fey have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of this clause shall continue to apply to such rights, obligations and liabilities indefinitely.

INDEMNITY

You agree to indemnify Anastasia La Fey, her collaborators, affiliates, employees, agents, contributors, third party content providers and licensors from and against:

(i) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any Content you post through the Website;

(ii) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms; and/or

(iii) any breach of the Terms.

DISPUTE RESOLUTION

(a) Compulsory: If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).

(b) Notice: A party to the Terms claiming a dispute ('Dispute') has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

(c) Resolution: On receipt of that notice ('Notice') by that other party, the parties to the Terms

('Parties') must:

(i) Within 14 days days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;

(ii) If for any reason whatsoever, 14 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the President of the Australian Mediation Association or his or her nominee;

(iii) The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation;

(iv) The mediation will be held in Melbourne, Australia.

(d) Confidential: All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

(e) Termination of Mediation: If 2 weeks have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

VENUE AND JURISDICTION

(a) The Purchase Services offered by Anastasia La Fey are intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Victoria, Australia.

GOVERNING LAW

(a) The Terms are governed by the laws of Victoria, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Victoria Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.

INDEPENDENT LEGAL ADVICE

(a) Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

SEVERENCE

(a) If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
